Terms of Service

1. Agreement to Terms

By accessing or using TheTradersHeaven (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. We may update these Terms from time to time; continued use after changes are posted constitutes acceptance, and we will notify users of material changes.

2. What the Service Is

TheTradersHeaven is an independent platform for traders that provides prop-firm comparison, a manual trading journal with automatic rule tracking (consistency, drawdown, targets), an ROI tracker, regional-availability information, news/calendar, and giveaways.

We are not a broker, a proprietary trading firm, or a financial institution. We do not hold or custody funds, execute or modify trades, or connect to your broker or prop-firm trading account. You enter your trade data yourself.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. If you use the Service on behalf of an entity, you represent that you are authorised to bind that entity.

4. Accounts

To use the journal and related features you must create an account using a valid email address or via Google/Discord sign-in, and choose a unique username. You are responsible for the accuracy of your information, for keeping your credentials confidential, and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

5. Plans & Payment

The Service offers a free tier and may offer paid plans. Some features (such as tracking additional accounts) may be unlocked by purchasing a prop-firm challenge through our affiliate links/codes, or through a future paid subscription. Paid subscriptions, when available, are billed on a recurring basis via Stripe and renew automatically unless cancelled before the renewal date. We do not store full card numbers. Unless stated otherwise, we do not offer refunds for partial billing periods; on cancellation you keep paid features until the end of the current period.

6. Affiliate Links & Independence

We participate in affiliate programs run by some prop firms and brokers. When you sign up through our links or codes, we may earn a commission — this comes from the firm, not from you, and you pay the same price. We are not affiliated with, endorsed by, or acting on behalf of any prop firm we list. See our Affiliate Disclosure for how we keep rankings honest.

7. Accuracy of Prop-Firm Information

Prop-firm data (prices, rules, drawdown types, consistency rules, country availability, payouts) is aggregated from public sources and provided for general information. Firms change their rules, pricing, and country restrictions without notice.We make reasonable efforts to keep data current but do not guarantee its accuracy, completeness, or timeliness. Always verify the current terms on the firm's official website before purchasing. We are not liable for decisions made in reliance on information shown here.

8. Not Financial Advice

The Service is an information and journaling tool only. Nothing on it constitutes financial, investment, or trading advice. Analytics, comparisons, calculators, and community content are for informational and educational purposes only and do not predict future results. Trading financial instruments — and attempting prop-firm challenges — involves substantial risk of loss, including the full cost of any challenge fees. Consult a qualified professional before making financial decisions. Past performance does not guarantee future results.

9. User Conduct

You agree not to:

• Use the Service for any illegal or unauthorised purpose.
• Harass, abuse, or threaten others, or post spam or misleading content in any community feature.
• Impersonate others or misrepresent your identity.
• Attempt to access other users' accounts or data without authorisation.
• Reverse engineer, scrape, or disrupt the Service or its infrastructure.
• Manipulate leaderboards or other features with fraudulent data.

Violations may result in suspension or termination without notice.

10. Intellectual Property

The Service — including its design, code, data compilations, and branding — is owned by TheTradersHeaven and protected by intellectual-property laws. You may not copy, modify, or distribute it without our written permission. You retain ownership of the content you create (journal entries, notes). If you post in any community feature, you grant us a non-exclusive, worldwide licence to display that content within the Service.

11. Third-Party Services

The Service relies on third parties including Supabase (authentication/database), Stripe (payments), Google/Discord (sign-in), cloud hosting, and an IP-geolocation provider. We are not responsible for the availability or practices of these services; your use of them is subject to their own terms.

12. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, technical issues, third-party outages, or events beyond our control.

13. Limitation of Liability

To the maximum extent permitted by law, TheTradersHeaven and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or trading losses arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months before the claim (or, if you paid nothing, a nominal amount).

14. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that any data or analytics will be accurate or complete.

15. Indemnification

You agree to indemnify and hold harmless TheTradersHeaven and its operators from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your trading activities and financial decisions.

16. Account Termination

You may close your account at any time from your profile settings or by contacting us. On deletion, your personal and journal data are removed in line with our Privacy Policy (subject to legal exceptions). We may suspend or terminate accounts that violate these Terms, with or without notice.

17. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes will first be addressed through good-faith negotiation; if unresolved, they will be handled by the competent courts or, where agreed, by binding arbitration.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
